This End User Agreement ("Agreement") is a legally binding contract between you (the "User") and SOMATÓRIO CELESTIAL UNIPESSOAL LDA. ("Flucks", "Company", "we", "us", or "our"), governing the use of the Flucks mobile application ("App") available on iOS and Android platforms.

By accessing, downloading, or using Flucks, you agree to comply with this Agreement. If you do not agree, do not use the App.

1. General Terms

1.1 Acceptance of Terms & Agreement Updates

• By using Flucks, you acknowledge and accept this Agreement.
• We reserve the right to modify this Agreement at any time.
• Users will be notified via email about major changes at least 30 days before they take effect.
• If you continue using Flucks after an update, you are deemed to accept the updated terms.
• The latest version of this Agreement will always be available in the App settings and on our website.

1.2 User Eligibility & Restrictions

• You must be at least 18 years old to use Flucks.
• You cannot use Flucks if you:
  • Are on any sanctions list (e.g., U.S. Treasury restrictions).
  • Have been convicted of serious crimes (e.g., fraud, sexual offenses).
• Users violating these restrictions may be permanently banned from the platform.

2. Content Ownership & Licensing

2.1 User Content & Ownership

• You retain ownership of any content you create or share on Flucks.
• However, by using Flucks, you grant us a non-exclusive, worldwide, royalty-free license to:
  • Store, display, distribute, and publicly perform your content within the app.
  • Modify content format for compatibility (e.g., resizing images).
• This license remains valid until you delete your content or account.

3. Community Guidelines & Content Moderation

3.1 User Behavior Standards

• Users must NOT:
  • Harass, threaten, or impersonate others.
  • Spread hate speech, discrimination, or violence.
  • Spam, promote, or advertise third-party services.
  • Share nudity, sexually explicit content, or illegal material.
• Violations may lead to content removal, account suspension, or permanent bans.

4. Spotify Integration & Third-Party Services

4.1 Spotify API Usage & Permissions

• Users can optionally link their Spotify account to Flucks.
• If linked, Flucks accesses the following Spotify data:
  • User email, playlist IDs, song IDs, artist names, and audio features.
• Users must grant explicit permission for Flucks to access Spotify data.

5. Account Security & User Responsibilities

• Users must keep their login credentials confidential.
• Flucks is not responsible for unauthorized access caused by weak passwords or credential sharing.
• Users must report suspicious activity or unauthorized access immediately.

6. Data Storage & Retention Policies

• Flucks stores user data until:
  • The user deletes their account, or
  • There is 1 year of inactivity.
• Upon deletion, user data is erased within 3 days, and Spotify-related data within 5 days.

7. Final Terms & Governing Law

• Flucks operates under Portuguese law and follows GDPR & CCPA regulations.
• Users will be notified via email at least 30 days in advance of major changes.
